Lawsuit in Boyertown Against School District for Supporting Trans Kids

The Boyertown School Board is being sued in Federal Court by the right-wing conservative group, the Independence Law Center, because they refuse to discriminate against transgender students. The plaintiff, backed by the Independence Law Center, is demanding that the school district create a policy that discriminates against trans students in order to drop the suit. If you missed the news, here’s a quick summary from the Reading Eagle:

“The Boyerstown School Board can avoid a federal lawsuit and its potential monetary damages if it changes its policy allowing transgender students to use the bathrooms and locker rooms of the gender with which they identify, according to a letter sent to the district.”

A priority for schools is to make sure every student feels valued and respected. Privacy and comfort are important for every student. School administrators and districts across the country have long been able to ensure that transgender students have access to facilities that match their gender identity while still protecting the privacy of all students. This helps ensure that all students, including students who are transgender, are able to learn and thrive as equal members of the school community.

This lawsuit is an effort to force a transgender student into facilities that don’t match their gender identity, and it would put them at risk for bullying, harassment and assault. And banning a transgender student from shared spaces is humiliating and adds to the bullying and mistreatment they face.

Unfortunately many transgender students face hostility, discrimination and bullying. According to the 2015 U.S. Transgender Survey, 54% of survey respondents reported having been verbally harassed in K-12 schools, and nearly one- quarter (24%) of respondents reported having been physically attacked in school because they were transgender.
